　就労ビザのように日本で働く事が認められている在留資格以外は、日本で働く事はできません。就労ビザであっても、認められている仕事以外で働く事はできません。アルバイトや副業を自由に行う事はできないのです。

　例えば、留学生は日本の学校に留学して勉強する事を認められている資格なので、留学ビザで自由にアルバイトはできません。ただし、本来の目的である学業の妨げにならない範囲でなら、生活費や学費をアルバイトで補っても構わないという建付けです。

　それを可能にするのが、資格外活動という許可（ビザ）です。本来の在留資格以外の活動も認めるというビザです。就労が認められていない在留資格の人でも、入管法第１９条で定められた資格外活動許可申請を行えば働くことが可能になります。

※　資格外活動の許可申請を行うのは、もともと就労が許可されていない外国人です。

※　就労が許可されている場合でも、副業をするような場合（ネットでの物品販売を営業として行う

　　ような場合・別の職種や職場でバイトもする場合）のように本来許可されている活動とは別の仕

　　事もする場合

　You cannot work in Japan unless you have a status of residence that allows you to work in Japan, such as a work visa. Even if you have a work visa, you cannot work other than the permitted job. You can't do part-time jobs or side jobs freely.

　For example, international students are permitted to study at a Japanese school, so they cannot freely work part-time with a student visa. However, as long as it does not interfere with the original purpose of studying, it is possible to supplement living expenses and tuition with part-time work.

　What makes this possible is the permission (visa) for activities outside the status of qualification. It is a visa that allows activities other than the original status of residence. Even those with a status of residence that does not allow them to work will be able to work if they apply for permission to engage in activity other than that permitted under the status of residence specified in Article 19 of the Immigration Control Act.

※　Foreigners who are not permitted to work in the first place apply for permission to engage in activities other than those permitted under the status of residence previously granted.

　資格外活動許可申請を行う在留資格は、主に３種類です。下記の資格では働くことは認められてませんが、資格外活動の許可を得ることで週２８時間以内の就労が可能になります。

　・留学生

　・特定活動の在留資格（卒業後の１年間で就職活動中の人）

　・家族滞在の在留資格

　留学生のアルバイトが典型例ですが、本来の学業に差し支えない範囲でのみ許可される性質なので、週２８時間以内のアルバイトでも、学校に全く行かないような場合は違反行為になります。アルバイトを雇う側も、学校に通っていない事を知りながら雇用し続けると、最近厳しくなった「不法就労助長罪」になってしまうおそれもあるので気を付けなければなりません。

　※　留学生に限って、長期休暇(夏休みや冬休み)には１日８時間・週４０時間まで可能です。
